SEC, PCC Seal Data-Sharing Pact to Strengthen Transparency and Fair Competition



MANILA – The Securities and Exchange Commission (SEC) and the Philippine Competition Commission (PCC) have strengthened their institutional cooperation after signing a Data Sharing Agreement (DSA) on Monday, aimed at promoting transparency, integrity, and fair competition in the Philippine corporate sector.

The agreement was signed by PCC Chairperson Michael Aguinaldo and SEC Chairperson Francisco Lim, granting the PCC streamlined access to corporate data held by the SEC that is essential to its mandate to investigate mergers, acquisitions, and anti-competitive practices under the Philippine Competition Act.

“This agreement represents a shared commitment to safeguard competition and protect investors,” Aguinaldo said. “By working closely with the SEC, we can ensure that markets remain transparent, competitive, and beneficial to consumers and businesses alike.”

Under the DSA, the SEC will provide requested corporate information to the PCC within three working days, while the PCC commits to using the data strictly for its lawful functions. The agreement also requires the PCC to notify the SEC of authorized personnel and data processors handling the shared information.

The pact establishes clear protocols for data breach management, data retention, and the secure disposal of personal data, ensuring accountability and the protection of data subjects’ rights in compliance with the Data Privacy Act of 2012.

Valid for five years, the agreement highlights the importance of institutional partnerships in strengthening market oversight, enhancing good governance, and boosting investor confidence across industries.

The DSA builds on the PCC-SEC Memorandum of Agreement signed in 2016, further defining procedures for data sharing through on-site, online, and off-site access to SEC records, while reinforcing safeguards for data privacy and security.

To oversee implementation and compliance, the SEC has designated Director Oliver Chato, while the PCC named Executive Director Kenneth Tanate as lead officials for the agreement.
