The Appeals Chamber of the International Criminal Court (ICC) has rejected the appeal filed by the camp of former president Rodrigo Duterte seeking his interim release from detention.
The appellate court affirmed the Jan. 26 decision of the ICC Pre-Trial Chamber I to keep Duterte in custody at the ICC Detention Center in the Netherlands, citing concerns about the risk that he could flee.
ICC spokesperson Oriane Maillet said on Friday that the Appeals Chamber unanimously confirmed the earlier ruling of the Pre-Trial Chamber.
“The Appeals judges unanimously confirm the decision of Pre-Trial Chamber I, which had remanded Mr. Duterte in detention,” Maillet said.
She added that the Appeals Chamber rejected all arguments presented by the defense and dismissed the appeal in its entirety.
The defense earlier argued that the Pre-Trial Chamber made factual and legal errors and abused its discretion when it disregarded a report on Duterte’s health condition. The chamber did not consider the report because it was submitted by a party involved in the proceedings.
However, the Appeals Chamber ruled that the report did not contain any new medical information. It noted that the two medical practitioners cited by the defense did not conduct a new examination of Duterte.
The judges also said that evaluating risk factors, including how Duterte’s health condition might affect those risks, is a legal determination that should be made by the Pre-Trial Chamber and does not require assistance from medical practitioners.
